This Privacy Notice (the “Privacy Notice”) describes how Ford-Werke GmbH („Ford“, (“we”, “our” or “us”) treats information (your “personal data”) that are recorded whenever you visit the website „Chemische Serviceprodukte – www.msds.ford.com“ (the “website”).


Recipients of your personal data

Your personal data may be disclosed to

  • companies or third parties that are assigned to provide services Ford, such as web hosting providers, direct mailing companies, analysis service providers, event organisers and IT providers;
  • companies or other third parties to which your personal data are disclosed at your request or with your consent;
  • consultants for the purposes of their professional activity, e.g. tax consultants or management consultants;
  • criminal prosecution authorities, courts, supervisory authorities, government agencies or other third parties, insofar as Ford deems this necessary in order to be able to comply with existing legal or regulatory obligations or otherwise safeguard the rights of Ford or the rights of third parties, guarantee the security of individuals, or identify, prevent or otherwise counter fraud or security issues; or
  • third parties which acquire from Ford or assign to Ford all assets and the entire business (or significant parts thereof). In case of such an assignment, Ford will make every reasonable endeavour to ensure that the recipient of your personal data use them in a manner consistent with this notice.

Cross-border transmission of your personal data

Your personal data will be treated in accordance with German data protection law and may be transmitted both within the European Economic Area (“EEA”) and also to countries outside of the EEA (including to the USA).
The countries to which your personal data are transmitted may not offer a level of data protection deemed appropriate by the European Commission. If your personal data are transmitted to countries outside of the EEA, Ford will take suitable measures pursuant to the legal requirements in the respective countries, in order to guarantee appropriate protection of your personal data, regardless of the country to which they are transmitted. Such measures may include obtaining contractual assurances from the third parties that gain access to your personal data, according to which said third parties undertake to afford your personal data a level of protection that is at least equivalent to the protection they enjoy within the EEA. Type of personal data used

Ford automatically collects personal data from the website through the use of cookies. More detailed information on this subject can be found in the section headed Cookies.

Ford may also be under a legal obligation to process certain personal data. In addition, we may be obliged to process your personal data under the terms of a contractual relationship entered into with you. Failure to provide such information may prevent or delay the fulfilment of these obligations.


Type of use of your personal data

We use the personal data collected on the website,

  • to operate the website and understand how the website is used in order to improve it accordingly, to meet legal and regulatory obligations of Ford, to respond to legal proceedings or provide information to government agencies or other third parties or to identify and/or prevent unlawful and fraudulent activities and protect your rights and the rights of Ford and of third parties.

Storage time of your personal data

Ford stores your personal data in identifiable format for as long as is required for the purpose for which they were collected and to fulfil the legal and regulatory obligations imposed. Your personal data are therefore generally stored until such time as one of the following situations occurs:

  • your personal data are reasonably required in order to provide the services you have requested;
  • your personal data are reasonably required to safeguard the rights of Ford and/or the property thereof (this normally applies for the statutory period of limitation); or
  • the storage of your personal data is prescribed by the applicable laws or ordinances.

Legal bases for the use of your personal data

There are various legal bases under which your personal data are used by Ford. Ford processes and uses your personal data in the following cases:

  • if the use of your personal data is required for Ford to fulfil the terms of one or more contracts to which you are party, or to be able to implement pre-contractual measures which you have requested. Such contracts can concern the participation conditions for a competition or agreements you conclude for service products;
  • if Ford or a third party to which Ford has disclosed your personal data has a legitimate interest in using your personal data and Ford has ensured that your personal data are protected and your rights in this respect are safeguarded. This legal basis exists, for example, if Ford and/or the companies of the Ford Motor Company Group use your personal data for the following purposes: for verifying and improving products, services and/or business or marketing strategies; for market analysis and market research; for study and research purposes; for handling and improving business relationships between Ford and you and for administrative purposes; to gain insights into which information, products and services are most likely to be of interest to you, and to send or show you information, offers and online advertising about these products or services; to adapt the products and services of Ford to your particular requirements; to ensure that the products and services of Ford are supplied, provided and used in accordance with the law and the conditions applicable to them; and – insofar as is required – to safeguard and defend the rights of Ford and its property and/or the rights and property of third parties, and also to identify and/or prevent fraud or security and/or data protection issues and to take appropriate countermeasures;
  • if Ford deems the use of your personal data necessary in order to comply with its legal or regulatory obligations;
  • in certain cases where, in the opinion of Ford, the security or the vital interests of third parties have to be protected;
  • in certain cases where Ford needs to use your personal data for purposes in the public interest;
  • and if you have granted Ford your consent. On the basis of this consent, Ford uses your personal data, for example, to send you advertising content by post, email, fax or text message. However, you have the right to revoke your consent to the use of your personal data for such purposes at any time. You will find more detailed information in the section headed “Your rights as a data subject” below.

Your rights as a data subject

As a natural person, you have the right to request information about the data stored about you by Ford and the purposes for which the data are stored, as well as access to this data and, if necessary, correction of this data. In certain cases, you can also object to the use of your personal data by Ford, for example, for contacting you for market research purposes or for the merging of your data from various sources; to demand the blocking or deletion of your data or to obtain your personal data in a standard electronic format to be able to transmit the data to third parties (often referred to as the right to “data portability”).

If you have given your consent to the use of your personal data (see section headed “Legal bases for the use of your personal data”), you have the right to revoke this consent at any time.
